Postcard conditions

My Design Postcard (hereinafter “Postcard”) is an individually designed postcard (with the dimensions of 148.00 x 105.00 mm) on which the picture (hereinafter “Picture”) received from the Client in digital form is printed.

Required data for the Picture to be added to the Postcard: data format: jpg, maximum size: 3 MB, minimum number of pixels: 472 x 472.

The colour settings displayed in the subscription environment of the Postcard and the printed Postcard may vary due to the differences in the monitor display settings and the colour settings used for personalisation (upon adding the Picture sent by the Client to the Postcard). 

Upon placing the Order concerning the My Design product, the Client commits to comply with the requirements for the Picture specified in the Terms and Conditions, otherwise it would not be possible for Post to complete the Order. 

By placing the Order, the Client confirms that he or she has the right to process, reproduce and distribute the image in the Picture; he or she does not violate any trademark rights, copyrights or other similar rights; he or she has the consent of all persons depicted in the Picture (or their parents or guardians) to reproduce the Picture that has been taken.

After having accepted the Order, Post verifies its compliance with these Terms and Conditions, including its compliance with quality and good practices. If the event of non-compliance of the Order with the said Terms and Conditions, Post may refuse to process the Order and shall inform the Client within 3 working days by email. Post reserves the right to refuse the acceptance of the Picture motif upon preparing the My Design product without justifying this in each individual case. 

Post has the right to refuse the reproduction of the Picture if any of the following circumstances is evident: The Client does not have any trademark rights, copyrights or other similar rights; the Picture or the words depicted in the Picture cause or may cause damage to the reputation of third persons; the Picture depicts naked people; the Picture or the words depicted in the Picture are obscene, unethical or contrary to good morals; the Picture or the words depicted in the Picture promote specific religious beliefs or may wound third-party religious beliefs; the Picture or the words depicted in the Picture may be insulting or offensive to some social, ethnic, racial or other group; the Picture or the words depicted in the Picture are essentially political or related to some political goal or campaign; the Picture or the words depicted in the Picture are unacceptable to Post for any other reason. 

If Post refuses to process the Order, Post shall immediately return the advance payment to the Client.

Post reserves the right to deduct the reasonable expenses incurred by Post upon handling the Order.

Those who have registered as users at Omniva’s online store can receive information about the Order status, and also place an additional Order to obtain My Design products that have been designed by the Client and already ordered previously. The registered users also have the option to maintain the Order related to the My Design products that have been designed but not formalised for up to 1 month, and confirm the Order and then pay for the Order within this period of time.

In the event of any non-compliance concerning the quality of the My Design products, the Client has the right to demand replacement of non-compliant products with new ones, provided that the Client returns the non-compliant products to Post and Post confirms the occurrence of non-compliance, i.e. the validity of the Client’s claim.
